These Terms and Conditions (“the Terms and Conditions”) govern the use of www.modernredd.com (the “Site”). The Site is owned and operated by Modern Redd (the “Owner” or “We”). By accessing and using the Site, the User (the “User” or “You”) agree to be bound by the Terms and Conditions set out in this legal notice.

Acceptable Use

The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the Site for marketing and other purposes without the consent of the Owner.

The User agrees to use the Site legally, not to use the Site for illegal purposes, and not harass or mistreat other users of the Site, violate the rights of other users of the Site, violate the intellectual property rights of the Site owners or any third party to the Site, act in any way that could be considered fraudulent, or post any material that may be deemed inappropriate or offensive.

If the Owner believes the User is using the Site illegally or in a manner that violates these Terms and Conditions, the Owner reserves the right to limit, suspend or terminate the User’s access to the Site. The Owner also reserves the right to take any legal steps necessary to prevent the User from accessing the Site.

Electronic Communications

By using this Site or communicating with the Owner by electronic means, the User consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

E-Commerce & Privacy

The Site sells handbags and accessories online. These Terms and Conditions apply to all the goods that are displayed or bought on the Site at the time the User accesses it. This includes all products listed as being out of stock. All information, descriptions, or images that the Owner provides about our goods are as accurate as possible. The Owner is not legally bound by such information, descriptions, or images as the Owner cannot guarantee the accuracy of all goods provided. The User agrees to purchase goods from the Site at the User’s own risk. The User indemnifies and holds the Owner harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Site. The Owner reserves the right to modify, reject or cancel your order whenever it becomes necessary. If the User’s order is cancelled and payment has already been processed, the Owner will give you a refund equal to the amount you paid.

The private information required for executing the orders placed through Site, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Owner and not sold or made known to third parties. Only the necessary information, which is the delivery address and contact phone number will be made known to third parties delivering the product. Credit card details are not kept by the Owner under any circumstances.

The Owner cannot be held responsible for security breaches occurring on the User’s electronic device (personal computer or other electronic device used to browse the Site), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

The Owner will supply all goods to the delivery company in good order. The Owner will not be held liable for the condition of goods arriving at the User’s chosen delivery address.

Refund and Return Policy

The provision of goods and services is subject to availability. In cases of unavailability, the Owner will refund the client in full within 30 days.

The Owner reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient, or the quality of goods ordered does not meet the Owner’s standards. Should the Owner exercise this right, the User will receive a full refund with no deductions.

Updating of these Terms and Conditions

Owner reserves the rights to change, modify, add, or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Site. It is the User’s obligation to periodically check these Terms and Conditions at the Site for changes or updates. The User’s continued use of this Site following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Copyright and Trademarks

Unless otherwise stated, copyright in all materials and content currently or anticipated to be displayed on the Site, including web pages, images, documents, data, graphics, audio, and video materials, is owned, licensed, or provided by the Owner, its affiliates and/or subsidiary, or any other third-party owners of such content and the User is only provided access for personal and non-commercial purposes; no part of this website or any content or materials appearing on it may be reproduced or reused without the prior written permission of the Owner. All trademarks, product names, and logos (the ‘Marks’) displayed on this website are proprietary to the Owner and are protected by applicable trademark and copyright laws. Nothing contained on this website should be construed as granting any license or right of use of any trademark which is displayed on this website without expressed permission from the Owner.

If you use any of Modern Redd’s marks to refer to our activities, products, or services, you must include a statement attributing that trademark to us. You must not use any of Modern Redd’s marks in or as the whole or part of your own trademarks, in connection with activities, products or services which are not ours, in a manner which may be confusing, misleading, or deceptive, in a manner that disparages us or our information, products or services (including this website). Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent, or other Intellectual Property Rights in or to the Content or material.

Limitation of liability

The Site and all content on the Site, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy, or completeness of the content. Neither Owner nor any holding company, affiliate or subsidiary of Owner, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Site or any functionality thereof, or of any linked site, even if the Owner is expressly advised thereof.

Privacy:  casual surfing

The User may visit the Site without providing any personal information. The Site servers will in such instances collect the IP address of the User’s computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Site, pages, etc. The Owner uses this information to determine use of the Site, and to improve content thereon. The Owner assumes no obligation to protect this information, and may copy, distribute, or otherwise use such information without limitation.

Choice of Law

This Site is controlled, operated, and administered by the Owner from its offices within the Unite States of America. Access to the Site from territories or countries where the Content or purchase of the products sold on the Site is illegal is prohibited. The User may not use this Site in violation of the United States export laws and regulations. If the User accesses this Site from locations outside of the United States, the User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the United States of America, and the User consents to the jurisdiction of the United States relevant courts in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect.
